KManager Terms and Conditions

This section explains the relationship between Air Malta plc and a KManager member.

1.0 General

1.1 KManager is the Corporate Frequent Flyer programme developed and designed by Air Malta plc, a company incorporated under the laws of Malta whose registered office is at Aviation Avenue Luqa LQA05 Malta. In these Terms & Conditions the terms "we", "our" and "us" means Air Malta. plc. The terms "you" and "your" means any corporate entity or organisation participating in the KManager programme.

1.2 Please read these Terms & Conditions carefully since they govern our relationship with you in respect of the Programme. By participating in the Programme, you are deemed to have read, agree to and accept to be bound by these Terms & Conditions.

1.3 These Terms & Conditions set out the relationship between you and us and govern the way in which you may earn KMiles and spend them for KManager Awards under the programme. All KManager accounts must be managed by a KManager Administrator and a Secondary Contact.

1.4. Please note that additional restrictions and requirements may apply to a particular Award or methods of earning KMiles as set out on the Flypass website www.airmalta.com/flypass.

1.5 Please be aware that these Terms & Conditions include limitations on our liability, our obligations relating to the Programme, and certain exclusions of responsibility.

1.6 These Terms & Conditions may be varied only by us and amendments to these Terms & Conditions will be made available on the Flypass website from time to time. Please double check to ensure that you are referring to the most up to date edition of the Terms & Conditions when participating in the programme.


2.0 Membership

2.1 Your membership of the programme shall be for an initial period of 12 calendar months, which is termed as the "Current Contract Period." KManager account will expire on 31st December and is to be renewed for another 12 months by the Administrator. Any KManager accounts registered in 2004, will be benefit from an extended contract period, which will expire on 31st December 2005.

2.2 To join KManager you must have at least 3 active members of staff who travel on your behalf on business, are already enrolled in the Flypass programme, and have earned at least 9,000 KMiles in 12 calendar months (January to December) through flying activity on Air Malta schedule flights. This activity threshold is based on the Base KMiles and excludes any additional KMiles earned through promotional offers such as Double KMiles, and any other KMiles credited to the account which are not based on flown earning activity. Through your KManager Administrator, you will be able to redeem your earned KMiles credited to the KManager account against KManager Awards for use by Travellers conducting business on your behalf. At your discretion you may also allow Travellers to redeem Awards for their Personal use.

2.3 Your nominated Frequent Flyers must be at least 18 years old and a member of the Flypass programme, whose Flypass account will be linked to the Corporate KManager account. Additional Frequent Flyers can be nominated during the Current Contract Period.

2.4 Your membership shall be subject to the provisions contained in these Terms & Conditions.

2.5 For every individual account that is linked to your Corporate KManager account, an Annual Linked Fee of Lm20 will be applied and a initial Bonus of 10,000 KMiles will be credited to the account.

2.6 The Administrator is to notify us with the intention to renew the KManager account at least 15 working days prior the expiry date. An updated list of the linked accounts is to be provided and the administration fee per account is paid at the time of renewal.

2.6 If you notify us that you no longer wish to participate in KManager, we will terminate your membership in writing. You will have 6 months from the date of termination to redeem any Flypass KMiles in your account. If your account balance is less than is required for the lowest Award available, KMiles will be forfeited.

2.7 To apply for membership you must enrol online through the www.airmalta.com/flypass. Upon completion of the enrollments process you will be allocated a KManager membership number to be used for administration purposes only.

2.8 We retain absolute discretion to accept or reject any application for membership for whatever reason, or suspend any membership account in the event of irregular or suspicious transaction or for any other reason.

2.9 Companies can hold only one KManager account at any time. KMiles cannot be transferred between KManager accounts or between the KManager account and an individual Flypass member account.

2.10 If more than one account number has been assigned to you in error, you must inform us immediately.

2.11 We retain the right to terminate your membership in the event of any breach by you of these Terms & Conditions. Any Award booking made by you either before or after the date of breach will be subject to review, and possible cancellation, by us.

2.12 Travel agencies, wholesalers, consolidators, and other sellers or bookers of travel are not eligible for KManager.


3.0 KManager Administrator and Secondary Contract

3.1 Your organisation should nominate a KManager Account administrator to handle communications with us in respect of the KManager programme. The Administrator should make sure that the Flypass members enrolled in both the Flypass programme and in KManager Account, are aware and have also given consent to the organisation, to have their Flypass account linked to the corporate KManager account.

3.2 If the Account Administrator is not successful in obtaining the express permission of Flypass member to link his/her personal account with the KManager account, then this individual account cannot be linked to KManager account. If this condition is not respected the KManager account will be terminated and all KMiles will be forfeited.

3.3 It is the Account Administrator's responsibility to update the account details as soon as possible when the status of any of the Flypass member's changes. At any time a Flypass member can be replaced with another new Flypass member if any of the Flypass members leave your organisation. There will be no switching costs.

3.4 The Account Administrator should make sure that at time of booking the Flypass membership number of each respective traveller/s is included in each booking. If the Flypass membership number is not included then the account will not be credited automatically.

3.5 You should also nominate a Secondary Contact who will have access to the administration of the KManager account and who will handle communications in the absence of the KManager Account Administrator.

3.6 The Account Administrator should complete the enrolment process. By doing so the Administrator is confirming that:

  • They have the authority to apply for membership on behalf of the organisation

  • The Programme Terms & Conditions have been accepted

  • Your Travellers have give permission for information on their travel to be reported back to the KManager Account Administrator and Secondary Contact.


3.7 The KManager Account Administrator or Secondary Contact can be changed at any time by the Chief Executive or Managing Director of your organisation.


4.0 General Reward KMiles

4.1 All Flypass Terms & Conditions apply to the individual members' Flypass Accounts.

4.2 You can redeem KManager KMiles against different Awards as set out in the Flypass website or as otherwise notified to you. Awards can be provided by us or through various organisations working with us as Programme Partners.

4.3 Only the KManager Account Administrator or Secondary Contact can initiate Award claims and authorise redemption of the KManager KMiles for the use of your employees.

4.4 You may claim Awards only once the sufficient KMiles threshold is reached in the KManager account

4.5 All Awards can be booked by calling the Flypass Service Centre on +356 22999425/6/7. Requests can also be done online via www.airmalta.com/flypass. Awards must be booked by sending a Confirm Reward Faxback form to +356 22999389.

4.6 KManager KMiles are valid for redemption at any time during the Current Contract period. If membership is renewed all accumulated KMiles are valid for 15 months since earning. If the account is not renewed or terminated in accordance with Clause 2.6, KMiles are valid for a further 6 months after the date your membership comes to an end.

4.7 All Award tickets are to be issued from Air Malta Sales offices only.

4.8 Award bookings are to be done directly via the Flypass Customer Service desk. Otherwise reservations may be cancelled and Travellers denied the Award without compensation.

4.9 Any changes to the award bookings or tickets are to be done directly with the Flypass Service Desk. In the case of ticket change, a rebooking fee of Lm30 per change will be applied.

4.10 KManager KMiles and Awards cannot be combined with, or added to, the personal Flypass KMiles and Awards, and cannot be used in conjunction with any other scheme or promotional offer.

4.11 The sale, barter or purchase of KManager KMiles is prohibited except in the instance of Awards being offered as prizes by your organisation through staff raffles. If you do not comply with this condition we may terminate your membership of KManager and any KMiles in the account will be forfeited.

4.12 We reserve the right to discontinue any Partner Awards at any time. We shall endeavour to give reasonable notice to the KManager Administrators before the Award is discontinued but are not responsible for actions or inaction of our Partners.


5.0 Earning KManager KMiles

5.1 KManager KMiles may be earned from the day of completed enrolment in the Programme.

5.2 KManager KMiles may only be earned for travel on Air Malta schedule flights. The KMiles earned will be based on the flown booking class.

5.3 KMiles will only be rewarded for the flights actually flown by the Traveller and will be based on the class of ticket paid for and will not reflect any complimentary upgrades.

5.4 There is no need to forward any evidence for mileage crediting. At the end of every quarter the activity registered in your Travellers' individual account in the previous 3 months will be replicated in the KManager Account. Requests for retrospective KMiles must be made within 90 days from the end of the respective quarter.

5.5 The Flypass member's personal Flypass account is not affected in any way by KManager. He/she will continue to earn KMiles on their personal account.

5.6 KManager KMiles can only be used by your employees. They cannot be pooled or assigned to subsidiary companies or passed to any other corporate entity or organisation (even in the event of a merger or acquisition) without our prior written consent.

5.7 Award Flights do not earn any KMiles.


6.0 Redeeming KMiles

6.1 All award levels are for a free return ticket excluding passenger taxes, duties, fees, charges and surcharges, which will be charged to and payable by each passenger. The amount of these is subject to change.

6.2 Award flight bookings should be made as from 45 days prior departure but not less than 7 days from date of departure. Any bookings made less than 7 days prior the commencement of travel will incur a Lm30 late processing fee.

6.3 Once an Award ticket is issue, you can effect a change to your travel date, route or class of service for a rebooking fee of Lm30 per change. Once tickets are issued no name changes are allowed. If you cancel an issued Award ticket the KMiles will be redeposited into your account for an administration fee of Lm30.

6.4 Outbound travel on Award flights must be completed within 1 month of the departure date.

6.5 Seats are allocated for Flypass and KManager awards on each Air Malta flight. However the number of seats available varies by season and day of the week. It may be possible that the Award Seat allocation is fully booked when there is availability in other booking classes.


7.0 Account Statements & Retroactive Requests

7.1 When you have joined KManager we will send you an online password that will give you online access to your KManager account.

7.2 If you have any queries relating to your statement please contact our Flypass Service Desk on 22999425/6/7. Any account discrepancies must be notified to us within 90 days of the date on which relevant KMiles are claimed to have been earned, or such KMiles will be forfeited.

7.3 In case of Retroactive credit requests, please ensure that together with the flight coupon you forward your KManager Account number together with the Flypass membership number of the passenger.


8.0 Changes

8.1 We reserve the right to change, replace, modify, temporarily suspend, terminate or cancel your membership and/or any aspect of the Terms & Conditions with immediate effect and at any time upon notice and regardless of the amount of KManager activity you have undertaken.

8.2 In particular we reserve the right to among other things, modify the Programme rules (including allocation of KMiles and the availability of Awards), exclude discount fare levels, rates and or tariffs from mileage credit and raised level of credit miles or change rates of redemption of KMiles required to redeem Awards at any time.

8.3 For the avoidance of doubt, we may terminate the Programme immediately if required to do so or by law, or if in our opinion, we believe it is desirable as a result of any change in the law or for any other reason.


9.0 Notices

9.1 If you or your Travellers do not comply with these Terms & Conditions or you or your Travellers misrepresent any information provided to us, your participation in the KManager Programme may be terminated, and all Awards and KManager KMiles forfeited.

9.2 Violating any of these Terms & Conditions may result in prosecution and liability for damages, litigation and related costs.

9.3 If you wish to terminate your membership please send a request in writing on your company letterhead, signed by the KManager Administrator or Secondary Contact. Please give 30 days notice.

9.4 Upon termination, all your rights with regards to KManager will cease, and all KMiles must be redeemed within 6 months from termination.

9.5 We may refuse to credit KMiles or process Redemption requests if we believe there has been fraud, breach or failure to fulfil any of these Terms & Conditions.


10.0 Taxation and Charges

10.1 Award flights are subject to the usual passenger taxes, fees, charges and surcharges, which are subject to change. You or the Traveller must pay these.

10.2 It is your responsibility to satisfy yourself as to the taxation of any KManager KMiles and Awards. Liability to tax may arise if KManager KMiles are earned by a Traveller in connection with that Traveller's employment. We are not responsible for any tax liability that you may incur through your membership of KManager and the redemption of Awards.


11.0 Confidentiality and Data Protection

11.1 You must not disclose to any third party the contents of these Terms and Conditions, nor any confidential information received through KManager, without our prior written consent

11.2 We will not allow your name and address or those of your Travellers to be used by unaffiliated organisations. However, we reserve the right to inform you about other products and services we offer.


12.0 Successors and Assigns

12.1 You may not assign your rights or delegate your duties under these Terms & Conditions without prior written consent. These Terms & Conditions are binding on the lawful successors of each party.


13.0 Liability

13.1 Unless stated otherwise, our standard booking conditions and General Conditions of Carriage apply to all reservations and flights. A copy of these is available on request.

13.2 We are not responsible for any consequences resulting from travel plans that are disrupted, changed or cancelled, for whatever reasons, including weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, or any other circumstances beyond our control.

13.3 Our responsibility for negligence, breach of contract, or another matter is limited to reimbursing your account with KManager KMiles equal to those redeemed for the Reward in connection with which the matter arose.

13.4 While every effort has been made to ensure all information in these Terms & Conditions are other publications is correct, we are not responsible for any printing or typographical errors, or any consequences from them.

13.5 Product design and specification is subject to change in line with our ongoing design and development policy.


14.0 Law and Jurisdiction

14.1 These Terms and Conditions are governed by and construed in accordance with the Maltese law.
